Kilmainham District Court has been told the State's delay in the case of a man charged was murder was "unforgivable". Solicitor Mr Neil McNelis was speaking in the case of Mr John Cleary (20), St Mark's Avenue, Clondalkin, who is charged with the murder of Mr Ken Foley at Jamestown Court, Inchicore on January 15th last.

The State solicitor in Kilmainham District Court asked for a remand for four weeks for directions. Mr McNelis said Mr Cleary had been in custody since January 16th and the DPP had received the files.

Judge Gillian Hussey agreed to remand Mr Cleary in custody to May 28th but warned if directions were not in court she would strike out the charge.
