A young garda got High Court leave yesterday to seek an order, by way of judicial review, quashing a decision of the Garda Commissioner to treat him as a probationer garda.
Mr Keith Marron, stationed at Rathcoole Garda station, is the subject of a Garda inquiry next Monday into his conduct arising out of an alleged breach of discipline.
It is claimed Garda Marron was convicted and fined at Naas District Court for a road traffic offence for using a mechanically propelled vehicle in a public place on March 24th, 2000, without insurance. The conviction was upheld on appeal to the Circuit Court.
Mr Justice Kelly said the issue was whether Garda Marron was a fully-fledged member of the Garda or a probationer. He granted leave to seek a judicial review on whether the Commissioner was right or not in purportedly extending the period of probation for Garda Marron.
