A company which has agreed, subject to planning permission, to allow Esat Digifone to erect a mast on its property in Co Cavan yesterday secured a temporary High Court order preventing about 20 local residents trespassing on the property.
Mr Justice McCracken granted the interim injunction, which is effective until Monday, to Gray Quarries Ltd for its property at Taghart, Shercock.
In an affidavit, Mr Sean O'Callaghan, transport manager of the company, said it had recently secured a contract to supply 40,000 tons of stone and gravel to a location at Knocknacrann, Carrickmacross, Co Monaghan.
Separate to the plaintiff's business of supplier of sand and gravel, it had agreed with Esat Digifone to allow it to erect a mast on its property at Taghart.
The development of the mast was subject to planning permission, and a decision was pending. Until planning permission was granted the company had no intention of allowing the mast to be erected.
Mr O'Callaghan said that when he arrived at the property yesterday morning the defendants were at the weighbridge inside the company's property. He was advised the defendants' entering the property was illegal.
The defendants had left following negotiations. However, they remained at the entrance, and because of their presence the company's trucks were unable to leave.
If the situation was to continue, the company would suffer irreparable harm, he said.
