The trial of a 17-year-old boy, who denies indecently exposing himself twice at the same location in Dublin, has been delayed due to a constitutional challenge.

The schoolboy is facing two counts under section 18 of the Criminal Law Act 1931 of exposing himself and urinating “to offend modesty, cause scandal and injure the morals of the community”, in front of people on April 13th and April 28th last year in west Dublin.

Defence solicitor Gareth Noble told Dublin Children’s Court that there had been a constitutional challenge brought to the High Court in relation to the wording of the type of charge brought against the youth.

Judge Ann Ryan adjourned the case until January pending the outcome of the test case.

The teenager, who was accompanied to court by his father, was remanded on continuing bail.

At an earlier stage the court had heard that the defendant was 15 at the time of the alleged incidents.
