THE POSTMORTEM on a Co Clare man who died following an alleged assault on St Stephen’s night has been postponed until today. Brian Casey (26), Lissycasey, died at the regional hospital in Limerick on Monday, following an incident at O’Connell Square in Ennis.
The postmortem by Assistant State Pathologist Dr Khaled Jaber had been due to take place yesterday. However, solicitor Tara Godfrey told a special sitting of Ennis District Court yesterday that the postmortem had been deferred to allow a pathologist on behalf of two men charged with assaulting Mr Casey to attend.
Harry Dinan (29), Waterpark Heights, Ennis, and his nephew, Kevin Dinan (22), Clarehill, Clarecastle, are charged with assaulting Mr Casey causing harm at O’Connell Square, Ennis, on December 26th-27th.
The two men were initially charged on Monday and were yesterday making their second court appearance. Bail was refused on Monday. Mr Casey, a teacher, died since their first appearance in court. Ms Godfrey, for the two accused, told Judge Joseph Mangan yesterday that she expected “more serious charges” to follow.
Ms Godfrey requested that Judge Mangan grant legal aid to allow a pathologist to attend Mr Casey’s postmortem on behalf of the defence which, she said, had been rescheduled for today. “That has become normal practice in cases like this,” she said. Judge Mangan granted her request.
Insp Michael Gallagher said it was the State’s application that the men be further remanded in custody to reappear before Ennis District Court on January 8th.
Judge Mangan remanded the two in custody to reappear on Friday week.
