Couple consents to summary judgment orders to repay €12.5 million

A couple have consented to summary judgment orders requiring them to repay Ulster Bank some €12.5 million over loans and guarantees mostly related to property and businesses in Sligo and Galway.

Barry Gavin, solicitor for John and Annette Curley, told Mr Justice Peter Kelly yesterday his clients were consenting to summary judgment in that sum. Given the couple's attitude, the judge told Kelley Smith, for the bank, he would only award costs at the lowest level – €202 – against them.

The couple, of Stradbally East, Kilcolgan, Co Galway, were sued arising from facilities advanced on dates from 2002, plus guarantees incouding one limited to €4.6 million for the debts of their company, Curley Furniture and Carpets Ltd (in receivership and in liquidation).

The loans were advanced for purposes including to buy a one-bedroom apartment at Salthill, Co Galway; a 18,000 square foot unit and 35 car parking spaces at Collooney Roundabout, Sligo; a site at Dublin Road, Oranmore, Co Galway ; a 7,000 square foot commercial unit at Sean Mulvoy Road, Galway and for investing in a property syndicate, the Stuggart Property Syndicate.
