DUKE McKENZIE faces legal action after pulling out of a non-title fight against Wayne McCullough on Saturday. McKenzie and Las Vegas-based WBC bantamweight champion McCullough were due to contest a 10-round bout in Denver. But the 33-year-old Croydon fighter had problems with his visa and is refusing to travel.

McCullough American manager Mat Tinley is resigned to looking for a new opponent and said: "I will definitely be suing McKenzie, who signed a contract for a six-figure pay day.

"It is a clear breach of contract by McKenzie and I'll be filing a complaint with the British Boxing Board of Control and Nevada State Athletic Commission.

"According to his promoter Frank Warren, who did everything he could to get him on a plane, McKenzie feels he wouldn't have had enough time to acclimatise.

"His visa wasn't accepted but with the help of a senator we managed to get it sorted out, but he still refuses to fight."

McCullough currently holds the WBC bantamweight crown but is on course to vacate the title and challenge for the organisation's super-bantamweight championship later in the year.
