MAYO woman Mrs Moira Gallagher has been refused free legal aid to appeal the Circuit Court order which requires her to build a boundary wall with her neighbour in Achill and get rid of a noisy rooster.

Mrs Gallagher (62), who is due to appear again before Westport Circuit Court in three weeks, said at the weekend she intended to appeal the legal aid decision as she has no funds of her own to fight the costly High Court battle.

Jailed for two weeks last year for contempt of court, Mrs Gallagher has not started to build a boundary wall as ordered by Judge Harvey Kenny because she is determined to appeal his order.

She got a letter last week explaining she was not entitled to free legal aid.

"I am appealing this as it would cost up to £5,000 to go to the High Court. I want to clear my name, she said.

Mrs Gallagher said friends had offered to hold a collection to raise the necessary money but she had declined this.

"I don't want to go to jail again but I will if I have to. Some people say I should build a wall and get it all over and done with, but why should I do so when I feel I am in the right?" she asked.
