Bupa challenge judgment due next week

The High Court will give judgment next week on the challenge by Bupa Ireland Ltd and Bupa Insurance Ltd to the legality of the risk equalisation scheme for the health insurance market.

Mr Justice Liam McKechnie will rule on the long-running case, which concluded earlier this year, on Thursday next.

The scheme announced by Minister for Health Mary Harney last year would involve Bupa paying a subsidy to its main rival VHI to compensate for the VHI having a greater number of high risk, older and more expensive subscribers.

Trial of man for Chawke robbery

A date has been set at Dublin Circuit Criminal Court for the trial of a man arising out of the armed robbery of publican Charlie Chawke three years ago.

Frank Ward (51) Knockmore Avenue, Tallaght, faces charges arising out of the shooting and robbery of Mr Chawke at the Goat Inn, Goatstown, Dublin, on October 6th, 2003.

Judge Bryan McMahon set the trial, which is expected to last two weeks, for October next year.

€38,000 damages for personal injury

A Co Wicklow woman, whose car was rammed at traffic lights, has settled her €38,000 damages claim for personal injury in the Circuit Civil Court.

Samantha Brodeur, wife of TV3 news editor, Phillipe Brodeur, suffered neck and back injuries in the collision at St Stephen's Green, Dublin, in March 2002. Mr Brodeur had already settled a damages claim.

Ms Brodeur, Rathdown Park, Greystones, Co Wicklow, had sued Bernadette Lynch, The Gallops, Ramsgate Village, Gorey, Co Wexford, owner of the car which crashed into her and Elaine Lynch, driver, of the same address.

False insurance claim charge

Two people, charged with falsely claiming to be involved in a collision, appeared before Enniscorthy District Court yesterday.

Kathleen Connors, Na Coillte, Bunclody, Co Wexford, was charged with attempting to obtain money from Hibernian Insurance Ltd by pretending she was involved in a crash.

John O'Connor, of the same address, was charged with pretending to drive a vehicle at Newtownbarry, Bunclody, on August 7th, 2000, which he claimed was involved in a crash causing injury to Ms Connors.

Judge Donnchadh Ó Buachalla adjourned the matter to January 10th, 2007, remanding the pair on continuing bail.

Man banned from airport

A man banned from Dublin airport was in custody yesterday after he was again found at the terminal on Tuesday.

Denis Craddock (56), Shanrath Road, Santry, Dublin, had been told to stay away from the airport last month as part of his bail conditions after he was arrested for urinating there and allegedly causing a breach of the peace.

Judge Bryan Smyth remanded Mr Craddock in custody to appear in Cloverhill District Court tomorrow.

Youth dangled boy over balcony

A teenager who dangled a younger boy over the balcony of a flats complex has been remanded in custody after Dublin Circuit Criminal Court heard he attacked the victim while on bail awaiting sentence.

Mark Pidgeon (16), Bluebell Road, Bluebell, pleaded guilty last July to reckless endangerment causing a risk of serious injury or death to the 14-year-old boy on July 18th, 2004.

Judge Frank O'Donnell had remanded him on bail so that various reports could be prepared for the court but noted when the case returned for decision yesterday that he had attended only three out of seven medical appointments in that time.
