A DUBLIN hospital has apologised to a senior member of its nursing staff and has admitted it was wrong to suspend her.

A DUBLIN hospital has apologised to a senior member of its nursing staff and has admitted it was wrong to suspend her.

Fionnuala Carty, Woodville Close, Woodville Downs, Lucan, had sued St James’s Hospital over her June 2010 suspension from her position as clinical nurse manager at the hospital’s intensive care unit following allegations of serious misconduct.

Although cleared of any wrongdoing following an investigation by the hospital, Ms Carty, on her return to work, was transferred under protest to another unit. She brought her High Court action seeking to be reinstated to her position.

Yesterday, on the third day of the action before Mr Justice Roderick Murphy, Oisín Quinn SC, for Ms Carty, said the matter had been resolved.

As part of that settlement, Mark Connaughton SC, for the hospital, made a statement that his client acknowledged “while the decision to implement a suspension was made in good faith, it was subsequently proven to be wrong in light of the findings of the investigation team.

“The hospital is sorry for the distress suffered by Ms Carty,” counsel said. It added that “both parties look forward to a continuing working relationship”.

The court also heard Ms Carty is to receive her costs. No other details of the settlement were revealed in court.
