A Limerick journalist, Frank Hamilton, who is serving three years' imprisonment for sexual assault, claimed in the High Court yesterday that his detention was unlawful because the offence for which he was sentenced no longer existed. Mr Justice Finnegan will give his decision tomorrow.

Hamilton (50), formerly of Shanabooly Avenue, Ballynanty, Limerick, had pleaded guilty in Dublin Circuit Criminal Court in 1998 to sexually assaulting a teenage girl in a hotel bedroom in 1994 and 1995.
