Bus driver in court over fatal accident on Dublin quay

A man employed as a driver for Dublin Bus has appeared before Dublin District Court in connection with an accident on Wellington Quay in February which left five people dead.

Mr Kenneth Henvey, of Whitethorn Crescent, Clondalkin, appeared before Judge James Paul McDonnell on Saturday morning charged with dangerous driving causing death.

Det Sgt John Doyle told the court he arrested Mr Henvey at Marlborough Street, Dublin, at 9.37 a.m. on Saturday. He was taken to Pearse Street Garda station. When the charge was put to Mr Henvey at 10.13 a.m., he had nothing to say in reply.

Det Sgt Boyle said gardaí had no objection to bail, and indicated that the matter would be tried on indictment.

Judge McDonnell asked Det Sgt Boyle if he could explain why details of the hearing and the charges had been broadcast on radio that morning following the publication of the same information in the print media.

Mr Henvey, who Judge McDonnell said was one of three interested parties in the case, still enjoyed the presumption of innocence. The DPP was another interested party, as were those who were injured in the incident and the families of the five people who lost their lives. The DPP had a "right and obligation to ensure the integrity of the prosecution".

Judge McDonnell listed the matter for mention on October 5th at Dublin District Court. He expected the DPP to indicate to the court "as to whether he considers it necessary to take any steps to protect the integrity of the prosecution".

Mr Henvey spoke only to confirm his name. He was not required to indicate how he intends to plead.
