A Central Criminal Court jury has heard that a murder accused identified the gun used to shoot a man in the head, according to garda interview notes produced in evidence yesterday.

During a series of interviews at Tallaght Garda station with Mr Shay Wildes, the accused, gardaí produced a semi-automatic handgun and asked him if he had seen it before.

"Yes, that's the gun you found at my home. It's the gun I used to shoot Joe Cummins," he replied.

The accused told gardaí he shot Cummins because he allegedly attempted to sexually assault the accused's sister, Catherine Wildes and hit her with a crowbar.

He said he had the gun in the top of his trousers and shot Cummins shortly after both men had left the Dragon Inn, Tallaght, where they had spent the afternoon drinking separately.

The memos read to the jury by Mr Tony Hunt, prosecuting, stated: "I was full of drink, it just happened. I went blank after that."

Asked by gardaí if more than one shot was fired, the accused replied: "I don't know."

When asked why he decided to shoot the deceased some 18 months after the alleged assault on Catherine Wildes, the accused replied: "He went missing."

"Was it always in your mind to do him harm of some description?" "Yes, like any brother would," Mr Wildes replied.

During the interview, gardaí put two names to the accused and asked if either man was the man who gave him the gun. "No" he replied.

"How did you know how to use a Bersa pistol?" "The man that gave me the gun showed me how to use it," the memo read.

Mr Wildes (35), Corbally Park, Blessington Road, Tallaght, Dublin, has pleaded not guilty to the murder of Joseph Cummins (48), Donomore Crescent, Tallaght on December 26th, 2001, at High Street Tallaght.

The accused also denies possession of a handgun and ammunition at Corbally Park, Tallaght, on the same date.

The trial continues today
