HIGH COURT:A man who claimed he was assaulted and dragged off a Dart train by security staff has been awarded €10,000 damages at the High Court.

The president of the High Court, Mr Justice Nicholas Kearns, said both sides were at fault but he was satisfied an unnecessary degree of force was used in taking David Gray off the train.

Mr Gray (45), Mount Talbot Court, Dublin, had sued Iarnród Éireann and STT Risk Management Ltd over an incident in April 2009 at about midnight at Connolly Station in Dublin.

The judge said there must have been something going on to warrant the intervention of the security men. Mr Gray had been drinking on top of taking methadone and was vulnerable in relation to his balance, he noted.
