Examiner for poultry firm with 200 staff

One of Ireland's largest poultry producers, which has more than 200 employees, has been placed under the protection of the High Court.

Ms Justice Mary Finlay Geoghegan yesterday appointed an interim examiner to Cappoquin Chickens after being told it has sustained losses over the last four years due to higher foodstuff costs, cheaper imports from South America and Asia, and the outbreak of Avian flu.

A statement of affairs of Michael D O'Connor, Sons Company Ltd, trading as Cappoquin Chickens, showed a deficit of €806,000 on a going concern basis and a deficit of €7 million if the company was wound up.

€500,000 award over wife's cancer

A man has secured €500,000 without admission of liability in settlement of his High Court action over the death of his 39-year-old wife from cancer.

Séamus Quinn, a father of two, had alleged there was a failure to properly and speedily investigate and treat a lump in his wife's breast.

Mr Quinn (39), Gortmyre, Coalisland, Co Tyrone, whose wife Angela died on September 30th, 2002, sued Prof Oscar Traynor, a consultant, of St Vincent's private clinic, Dublin; St Vincent's Healthcare Group; a nominee of St Vincent's Private Hospital; and Dr Yvonne Rafter, a GP, Highfield Road, Rathgar, Dublin.

Mr Justice Paul Gilligan heard the case had been settled with an offer of €500,000 by Mr Traynor, and could be struck out against all the defendants.

€850,000 for bus death family

The family of a man who was among five people killed when a Dublin Bus mounted the kerb at Dublin's Wellington Quay have secured €850,000 to settle their High Court action.

Svitlana Tyminsky (35) and her daughter Khrystyna (15), originally from Ukraine but with an address at Kew Park Avenue, Lucan, Co Dublin, brought the action against Dublin Bus arising out of the death of Vasyl Tyminsky. They claimed damages for wrongful death, nervous shock and mental distress. Liability was admitted by Dublin Bus.
