A €47 million Dublin property sale may proceed after a woman consented before the High Court to a declaration that she has no claim to a house and lands being sold by her brother, well-known businessman Mr Tom Roche.

Mr Roche had issued proceedings against Ms Eleanor Roche seeking a declaration that she had no interest in the property, Chesterfield, Cross Avenue, Blackrock, which he is selling to Mr Myles and Ms Karen Crofton and Marchmain Securities Ltd.

When the case was before Mr Justice Kelly last week, he was told the sale, which was due to close on November 30th last, had been deferred. The purchasers had agreed to a revised closing date if the claim made on behalf of Ms Roche against the purchasers was withdrawn or the matter was decided by the court.

Yesterday, the judge was told that Ms Roche was consenting to a declaration that she has no claim whatsoever in law or in equity to the property or any part of it. It was stated the declaration was without any prejudice to any personal claim which Ms Roche may wish to make against Mr Roche personally, which claim he did not admit.
