AIB seeks €2.2m judgment against Dublin couple and daughters

Money funded property purchase and overdrafts, with bulk guaranteed by parents

AIB is seeking summary judgment against a couple and their two daughters for amounts totalling just over €4 million arising from loans and guarantees to buy property and to fund overdrafts.

Judgment is sought against Joseph and Ann McGouran, Hillcourt Park, Glenageary, Co Dublin, their daughter Ann, of the same address, and daughter Bronwyn, who lives at Tubbermore Road, Dalkey, Co Dublin.

Mr Justice Brian McGovern admitted the case to the Commercial Court list on consent between the parties. A hearing of the summary judgment application will take place in early October.

Cathal Hardiman, a manager with AIB and AIB Mortgage Bank, said in an affidavit that the total amount owed by the daughters, as of April 2016, was €2.21 million. The parents are liable for €1.88 million of that under guarantees they provided.

Mr Hardiman said the case arose out of a number of loans and guarantees entered into between 2001 and 2013, including for the purchase of a property at Serpentine Avenue, Ballsbridge, Dublin.

Despite considerable efforts between the bank and the defendants to help them address their various debts, and despite significant pre-legal action negotiations with their financial adviser for more than a year, it has not resulted in any settlement between them, Mr Hardiman said.
