A man who did not succeed in a private prosecution against a neighbour for alleged criminal damage was ordered to pay £1,000 in legal costs yesterday. Eugene Farrelly, of Watermill Avenue, Raheny, lost the action he took against Mr Robert Burtonshaw, who he alleged had caused £1,350 damage to his car in the early hours of September 14th last year.

The District Court President, Judge Peter Smithwick, dismissed the case last month, saying that he had a reasonable doubt after hearing evidence from both sides.

Judge Smithwick found that Mr Farrelly was liable for Mr Burtonshaw's legal costs.

Yesterday, Judge Miriam Malone was told that a figure of £1,000 had been agreed. She ordered Mr Farrelly to pay this sum to Mr Burtonshaw by the end of November.
