Fyffes today said the Supreme Court has issued an order in its favour for all costs in the High Court and Supreme Court actions in its legal action against DCC.

Fruit distributor Fyffes had initiated the legal action against DCC; its executive chairman, Jim Flavin; and its two units - S&L Investments and Lotus Green - in connection with the sale of about 31.17 million Fyffes shares in February 2000.

The company also said that the Supreme Court has referred the case back to the High Court to determine the amount due to Fyffes arising from the unlawful dealing by the defendants.

The High Court is expected to determine this matter in 2008, Fyffes said.
