London - A newspaper photographer, Mr Alberto Diaz Gutierrez, better known as Alberto Korda, has started legal proceedings against the promoters of Smirnoff vodka for using a famous photograph he took of Che Guevara standing on a platform with the Cuban president, Dr Fidel Castro, for an advertising campaign.

In what is expected to be a landmark copyright case, Mr Korda (71) is suing the advertising agency that developed the campaign for "spicy" vodka, the London-based Lowe Lintas and the picture agency that supplied the image, Rex Features. If the case is not settled before the suit is heard, it will come before the high court in London next month.
