A MAN charged with raping an 87 year old Dublin woman will stand trial despite the recent death of his alleged victim, a court heard yesterday.

The DPP has decided there is still enough evidence to mount a prosecution in the case, a State solicitor, Ms Claire Galligan, told Dublin District Court. A 22 year old north Dublin man is accused of raping the woman in Phibsboro on December 6th, sexual assault, aggravated burglary and criminal damage.

Sgt Michael O'Brien asked that the accused observe a curfew from 8 p.m. to 8 a.m. as part of bail conditions and sign on daily in a Garda station. In addition, there should be no application for a passport. Judge Thelma King remanded the man in custody for a week to allow surety be approved for in dependent bail of £3,000.
