ANTI-WAR ACTIVIST Mary Kelly has resolved her High Court action aimed at blocking the broadcast of a TG4 documentary about her life story.
Ms Kelly was seeking to stop the airing of the programme Mary Kelly sa Bhearna Bhaoilbecause she considered that it had defamed her. On Tuesday the peace activist told the High Court that she was seeking an injunction after having viewed a DVD copy of the documentary.
At the High Court yesterday, following discussions between the parties, Ms Kelly and Patrick O'Reilly, counsel for programme makers Poolbeg Productions Ltd, told Mr Justice Bryan McMahon that the parties had come to an agreement.
No terms of the settlement were revealed to the court. However, the programme was scheduled to be broadcast on TG4 last night.
Ms Kelly also said that while she was withdrawing her motion for the injunction, she was reserving her position until after the documentary was broadcast.
Mr Justice McMahon, who had viewed a copy of the programme, struck out the case and made no order as to costs.
Ms Kelly, a nurse and mother of four, took an axe to a US navy aircraft at Shannon airport in August 2003 and caused an estimated $1.5 million worth of damage. In 2004 she was given a suspended jail sentence at Limerick Circuit Court.
