A move by a public house group to hold a mother responsible for her four-year-old daughter's accident has failed.

A move by a public house group to hold a mother responsible for her four-year-old daughter's accident has failed.

Kelly Gorman, of Sillogue Avenue, Ballymun, was injured in The Castle Inn, Finglas, Dublin, the Circuit Civil Court heard. The pub had claimed the accident happened because the girl had been left unsupervised despite public announcements to mothers to control children.

Company director Mr Chris Kelly wanted Mrs Anne Gorman, of Sillogue Avenue, Ballymun, joined as a third party to her daughter's claim. In such a case the pub, if held responsible, could have sought to recover damages and costs from Mrs Gorman.

Judge Michael White refused The Castle Inn leave to join the mother.
