Iarnrod Eireann gave the High Court an undertaking yesterday that it would not pursue a disciplinary hearing against one of its locomotive drivers pending the outcome of legal proceedings.

Earlier this week, Mr John Rogers SC, for 11 drivers who are members of the Irish Locomotive Drivers' Association (ILDA), said a ballot on a new deal for the drivers had been suspended.

At that hearing, Ms Justice Laffoy granted an interim order to one driver, Mr Brendan Ogle, who had acted as a spokesman for the National Locomotive Drivers' Committee, before the ILDA was set up.

The order restrained Iarnrod Eireann from continuing with disciplinary proceedings against him.

Ms Justice Laffoy also gave permission to serve Iarnrod Eireannwith notice that the drivers intended to seek to prevent a conclusion of the new deal between the company and drivers.

The company has taken separate High Court proceedings against the drivers, claiming the 11 named persons had instigated, organised, incited and promoted industrial unrest, including illegal work stoppages.
