A former asset recovery agent was found guilty yesterday by a District Court judge of assaulting a man who was in arrears to ACCBank in relation to a five-year-old Toyota Hiace van.

Judge Mary Devins at Castlebar District Court also ruled that Aidan Faulkner (52), Clogherhead, Co Louth, had trespassed on the property of Patrick Ruane, Straide, Foxford, Co Mayo, on April 21st, 2010. She adjourned sentencing to July 27th.

An earlier court was told that Mr Ruane had been terrorised by the actions of Faulkner, who headbutted him, leaving him with a broken nose, a split lip and damaged teeth. The incidents were captured on CCTV.

The van was on hire purchase from ACCBank. Mr Ruane admitted missing the last three repayments amounting to €843. The total loan taken out was €17,900.

Judge Devins said Faulkner “had absolutely no right to be on the property” and the CCTV footage had shown definite assault of a man on his own property.

At the time Faulkner was working as an asset recovery agent for Auto Trace Solutions. The court was told yesterday that the company had gone into liquidation 18 months ago.
