THREE MEN appeared in court in Dublin yesterday in relation to a shooting incident near Cherry Orchard Hospital, Ballyfermot, Dublin, on Monday night.

David Byrne (26), Raleigh Square, Crumlin, Eugene Cullen (25), Sundale Villas, Tallaght, and Adam Griffiths (20), Rafters Road, Drimnagh, appeared before the Dublin District Court in the Bridewell on separate charges relating to the unauthorised taking of a vehicle.

All three were remanded with consent to bail to appear next Thursday at Cloverhill District Court. Each of them has to follow a number of similar conditions requested by arresting gardaí and granted by Judge Hugh O'Donnell.

Gardaí in the Organised Crime Unit have been investigating the circumstances surrounding the shooting of a 20-year-old man in the Ballyfermot area.

The victim was hit in the lower torso and was recovering in hospital this week.

Mr Byrne was charged with assisting another person to commit an arrestable offence at Palmerstown Court, Palmerstown, Dublin. This related to the theft of a car and was contrary to section 7 of the Criminal Law Act.

Bail was granted on his own bond of €3,000 and an independent surety of €3,000. Det Garda Georgina Earley said that when he was arrested and charged on Wednesday night, he made no comment.

He must reside at his own address and notify gardaí of any change of address; sign on twice daily at Blackrock Garda station; surrender his passport immediately and not apply for a substitute one.

Mr Byrne must maintain a curfew between 10pm and 7am and stay out of the Dublin 10 and Dublin 20 areas, which include Ballyfermot and Palmerstown. He must not associate with the two other defendants or drive a vehicle until the conclusion of his case.

An application was made for legal aid.

Mr Cullen was charged with allowing himself to be carried as a passenger in a stolen car at Palmerstown Green on Monday and was also told not to have contact with Mr Byrne or Mr Griffiths.

His bail was set at his own bond of €5,000 and two independent sureties of € 2,500 each. An application for legal aid was made. In addition to other conditions, he must sign on twice daily at Tallaght Garda station, give up his passport and not enter the Dublin 10 or 20 areas.

Mr Griffiths was charged with unlawfully using or taking a car at Palmerstown Green on Monday.

Det Garda Ronan Doolan told the court that Mr Griffiths was arrested at Clondalkin Garda station and said nothing when cautioned and charged.

Five men were arrested by detectives involved in the operation in west Dublin.

A Garda spokesman said yesterday that in addition to the three men who appeared in court, two others were released without charge and a file is being prepared for the Director of Public Prosecutions.
