Forty-nine Romanians have been granted leave by the High Court to seek, in judicial review proceedings, orders directing the State to consider their asylum applications in accordance with the European Convention of Human Rights. Mr Justice Kinlen also granted an order restraining the deportation of two of the Romanians on Thursday and any other deportation orders which might be made against the other applicants pending the outcome of the proceedings against the Minister for Justice, Ireland and the Attorney General.

The Romanians claim they will be subject to persecution and human rights violations if returned to Romania. They want orders directing the authorities here, when processing their applications for asylum, to consider the human rights situation in Romania and whether there are breaches of the European Convention of Human Rights.

An order is also sought directing the Government to take proceedings against Romania before the European Court of Human Rights.
