Solicitor being sued over alleged negligence on site purchase

A man is suing a solicitor for €5 million over alleged negligence related to a contract for the joint purchase by both men of a site at Clonsilla, Dublin. Mr Justice Peter Kelly was told yesterday that Kenneth O'Reilly is in the proceedings effectively claiming an indemnity against Patrick Delaney, practising as P. Delaney Co Solicitors, Main Street, Castleknock, Dublin, in relation to a judgment for €5 million granted against both men in December last.

The judge transferred the proceedings to the Commercial Court. Mr O’Reilly, Scribblestown, Dublin, has brought the action arising from a contract executed in April 2007 for the purchase by both men of lands at Kellystown, Clonsilla.

Man faces trial for sexual assault

A man charged with sexual assault of a woman is to face trial at the Dublin Circuit Criminal Court, the Director of Public Prosecutions has directed.

The man is accused of a sexual assault in north Dublin last October.

Dublin District Court heard yesterday that the defendant (49) would be served with the book of evidence in the case at his next appearance in May.

The prosecution told Judge Denis McLoughlin that the DPP had directed that the man was to be tried on indictment, which means the case will go before the Dublin Circuit Criminal Court.

The accused was in court yesterday and represented by solicitor Michael Staines, who said his client was anxious for matters to proceed.

The defendant, described earlier as "businessman of impeccable character", is on bail and will be served with the book of evidence in the case when he appears again at the Dublin District Court on May 16th.

Stay on €1.1m order against loan agreed

A man has secured a stay on a €1.1 million judgment order made against him at the Commercial Court arising mainly from a loan to invest in property in Montenegro.


Bernard Llewellyn, Charlotte Quay, Dublin, and Ramada Hotel Resort, Drumshanbo, Co Leitrim, secured the stay yesterday from Mr Justice Peter Kelly to October after outlining proposals aimed at paying off some of the monies due to Bank of Scotland.

Receiver backed by IN&M over 'Tribune'

Independent News and Media (INM) is to indemnify the receiver of the Sunday Tribuneover costs of court proceedings brought by him against the Irish Mail On Sunday, the Commercial Court has heard.

The action by receiver Jim Luby is over publication by the Mail on Sundayon February 6th of an alleged fake copy of the newspaper after it went into receivership.

Some 10,000 copies were sold.
