The High Court has upheld the decision by the Broadcasting Commission of Ireland  to award the radio licence for the north west region to Ocean FM in preference to the existing licence holder NWR FM.

In a judgment issued this morning the Honorable Mr Justice Michael Peart, upheld the BCI's decision to award the licence for Donegal South/Sligo/Leitrim North to North West Broadcasting Ltd., trading as Ocean FM.

In a bitter legal dispute NWR had challenged the BCI's decision to strip of its licence as part of the re-licensing process for local commercial radio which took place during 2002 and 2003.

There were three applications for the licence, oral hearings for which took place in Donegal town on March 24th of last year.

BCI chief executive, Mr Michael O'Keeffe, said the commission was delighted with the outcome and that the award of the contract to North West Broadcasting will "best serve the needs of listeners in the franchise area."
