Mr Justice Flood and Mr Garrett Cooney SC made no reference to the dispute between them last week when the tribunal resumed yesterday. However, Mr James Gogarty made two mentions of it.

The first was when Mr Cooney asked him about discussions he had had with Mr Michael Bailey about the sale of Murphy lands before June 8th, 1989, and the phrase "our many discussions" concerning it in a letter.

Mr Cooney: "Now I mean, Mr Bailey, I beg your pardon, Mr Gog arty. Mr Gogarty, this is a very simple phrase, it has only one meaning and that is that there were many discussions." Mr Gogarty: "I don't take your word for meaning because you have already sought the Bar Council to give you a form of words." Mr Cooney said he would ignore this sort of remark.

The second reference came later when Mr Gogarty said something had slipped his mind but that it would come back to him. Mr Cooney: "Well, interrupt me if it comes back to you."

"I don't intend to be rude to interrupt you. I am only trying to put something in the context," said Mr Gogarty. Mr Cooney: "Sure, I understand that." Mr Gogarty: "If that is being rude I apologise and I won't look to the Bar Council for the forming of the words either."
