A challenge by a former manager of Bohemians Football Club to his alleged dismissal will be heard by the High Court next month.

Yesterday the court was due to hear Mr Joe McGrath's application for a restraint order against the club which claims Mr McGrath resigned and was not dismissed.

However, Mr Bill Shipsey SC, for Mr McGrath, told Mr Justice O'Sullivan that the conflict between the parties could only be resolved by oral evidence and it had been agreed by both sides to look for an early trial date of Mr McGrath's claims.

Mr Shipsey said Bohemians were competing in the Premier League and he was not asking for a restraint order against the club at this point.

Mr Adrian Hardiman SC, for Bohemians, said his clients claimed Mr McGrath had not only resigned but had acted inconsistently with his role as manager by asking players to join other clubs and by having acted as an agent for the New Zealand Football Association.

The judge fixed November 10th for the hearing.
