Defence lawyers are to challenge the validity of a Central Criminal Court jury's verdict that a 38-year-old man it cleared of raping a woman was guilty of sexually assaulting her.

The jury found the man not guilty on November 9th of raping the woman, but then found him guilty of sexual assault on her in the same incident. He has been in custody since then.

The man denied raping the then 20-year-old former work colleague on June 4th, 1999, at the Bolton Court Apartments, Bolton Street, Dublin.

Mr Justice O'Sullivan has set next Tuesday as the possible date to hear the application to have the verdict set aside on the grounds it was "perverse" in the light of the not-guilty verdict on the rape charge.
