One of the protesters against the proposed dual carriageway scheme at the Glen of the Downs yesterday indicated through his barrister that he would give an undertaking not to interfere with the road works.
At the High Court, Mr Graham Quinn, for Mr Aidan Corcoran, told Mr Justice McCracken that his client was in hospital with a back complaint. He said Mr Corcoran had indicated to him last week that he was prepared to give the undertaking sought.
Mr Dermot Flanagan, for Wicklow County Council, said he would prefer if some form of written evidence was tendered to the court to explain Mr Corcoran's absence.
Mr Justice McCracken said he would adjourn the proceedings until Friday.
