THE OPERATORS of a south Dublin creche have secured a temporary High Court injunction that allows them access to their premises, which they had been locked out of “without prior notice or explanation”.

Sandyford-based Fun Fitness Ltd, which leased and shared its premises from the company that operated the Total Fitness chain of gyms, sought orders from the court after finding itself, without warning, locked out of its premises on Thursday.

Fun Fitness Ltd, which runs its creche business at Backglen Road, Sandyford in Dublin, claimed that while it had received no explanation as to why it had been locked out by its landlords, it believed the move was linked to reports that Total Fitness, which operated three gyms in Dublin, had gone into liquidation.

Yesterday at the High Court Fun Fitness, which claimed that its business would be seriously damaged as a consequence of being locked out, secured a number of interim injunctions against the company which runs the gyms, Centre Operators Ltd. That firm is a subsidiary of the UK-based Total Fitness Group.

The injunctions include that the defendants restore Fun Fitness’s right to access to the premises.They were granted by Ms Justice Mary Laffoy, on an ex parte basis.
