Former Dublin assistant county manager Mr George Redmond has failed to discover documents sought by the Flood Tribunal, the High Court was told yesterday.

The President of the High Court, Mr Justice Morris, gave leave to the sole member of the tribunal, Mr Justice Flood, to issue a summons against Mr Redmond returnable to June 15th.

Making the application, Ms Patricia Dillon, for the chairman, said Mr Redmond had defaulted on complying with the orders and her client wished to issue a summons. Three orders for discovery were made by the tribunal, on January 26th, February 19th and April 19th last. She suggested that the matter be put in for June 15th in the High Court, with liberty to Mr Redmond to file such affidavits before then as he considered necessary.

In separate proceedings last week, the High Court rejected a Criminal Assets Bureau application for an order compelling the tribunal to make available to it documents relating to the tribunal's efforts to obtain - from parties other than the CAB - material seized by it from Mr Redmond.

The CAB had sought the documents for judicial review proceedings in which it is challenging the Tribunal's decision that it must produce to it documents seized by the bureau from Mr Redmond on February 15th last. That action is to be heard on June 15th.
