Killiney repairs

A prosecution against Iarnrod Eireann for occupation of Killiney beach, Co Dublin, while carrying out rail repairs would not succeed, the Minister for the Marine said.

Mr Fahey, in a written reply, said the company claimed it needed no permission for emergency work and the Attorney General advised that legislation dealing with the maintenance of railways had precedence over the Foreshore Acts where there was urgent work, essential for public safety.
