A Finglas man who suffers from acute schizophrenia has been jailed for four years by Mr Justice Carney at the Central Criminal Court for raping his young nephew.

The 34-year-old pleaded guilty to three charges of abusing his nephew between 1995 and 1997. He was also jailed for two years concurrently on two sex assault counts.

The judge said that due to the rape charge he could not concede to the submission by defence counsel Mr Hugh Hartnett SC for a non-custodial sentence, but based on the evidence the four-year sentence was at the lower end of the scale.

Sgt Kevin Carey told prosecuting counsel Mr Brendan Mulhall the defendant indicated he had been sexually molested by a named now-deceased neighbour during a visit to England as a child. He suffered a nervous breakdown as a teenager and had been admitted to St Brendan's Hospital, Grangegorman, Dublin.
