Fitness centre and landlord settle dispute

A Dublin fitness centre operator who alleged he was unlawfully locked out over rent arrears is back in occupation of the premises, the High Court was told in Dublin yesterday.

Following talks between lawyers for Z Fitness Ltd, trading as SV Fitness Centre, IFSC, Dublin, and representatives of the landlord of the building, Mr Justice Roderick Murphy was told an injunction application was not proceeding as the matter had been resolved.

Last Tuesday, Z Fitness got permission in court to serve short notice of proceedings on the Origin 8 Partnership, landlord of the Mayor Street building in Dublin which houses the 10,000sq ft fitness centre.

Yesterday, Pádraic Lyons, for Z Fitness, said the matter had been resolved and could be struck out with no order save for the reoccupation of the premises in Mayor Street by his client.

Court told of marks on stolen sterling

A Northern Bank employee could identify her handwriting on almost 300 sterling notes recovered by Cork gardaí during searches in early 2005, the Special Criminal Court heard yesterday. Sonia Moore said marks she made as part of her job were visible on 287 bank notes. £26.5 million was stolen during a robbery in 2004. Tom Hanlon (43), Pembroke Row, Passage West, Cork, has pleaded not guilty to IRA membership.

Man struck by garda awarded €9,240

A young man who claimed he suffered a fractured jaw after being struck twice in the face by a garda while in custody in Blanchardstown Garda station has been awarded €9,240 damages by a High Court jury.

Salko Osmanovic (22), a native of Bosnia who has lived here since he was a child, had sued the Garda Commissioner, Ireland and the Attorney General.

Search for teen boy gone from HSE care

The High Court has asked gardaí to search for a troubled teenage boy who went missing from HSE care yesterday morning. Mr Justice George Birmingham said that if the 14-year-old - a victim of sexual and physical abuse described as a risk to himself and others - was found, he should be taken to a secure residential unit pending proposed placement in a special unit in Scotland.

Teens charged with head-shop mugging

TWO teenage boys were charged yesterday with mugging a man for items he bought in a Dublin city-centre head shop. The pair, aged 16 and 17, have been charged at the Children's Court with attempted robbery of the man (20), in Trinity Street, Dublin 2, on April 28th. The man had been to the Nirvana shop, on South William Street, and was allegedly followed by the boys.
