Esat Digifone has been ordered by the High Court to remove its recently built relay station on Croghan Hill, Co Offaly, and reinstate the lands. Mr Justice Kelly also prohibited the company from using the works already installed.
Offaly County Council had sought an injunction against the company on the grounds that the development had gone ahead without planning permission.
Mr Pat Butler, counsel for the local authority, told the court the action had been settled on the basis of agreed court orders with a stay until August 31st and with costs against Esat.
