A taxi-driver whose car ran over a woman lying on the road four years ago was in no way morally culpable for her death but was 100 per cent liable, Judge John O'Hagan said in the Circuit Civil Court yesterday.

He said the driver, Mr Kevin Carey, "should have been driving within the vision of his headlights and capable of stopping". He was going to have to live with the horrible experience for the rest of his life.

Mr Carey told the court that when he first saw Ms Teresa Gray lying on the New Cabra Road, Phibsboro, Dublin, she was only feet from his car.

The action was taken by Ms Ann Byrne, Beresford Avenue, North Strand, Dublin, on behalf of her sister's estate.
