A mechanic who worked in the family garage business and contracted asthma from a paint spray was awarded £135,056 in the High Court yesterday. Mr Desmond Noone (43), Lara, Maynooth, Co Kildare, had taken the action against Brian Noone Garages Ltd, Mill Street, Maynooth.

The court was told that Mr Noone was not involved in the paint spraying, but worked in the proximity of it. The paint contained isocyanate, a potent chemical which could bring on asthma.

Mr Justice Kelly, giving judgment, said he was satisfied Mr Noone had chronic asthma, which would remain for life. The award, totalling £135,156, included £40,000 for pain and suffering to date £60,000 for future pain and suffering; £30,368 for loss of earnings £30,368; and £4,688 for cost of drugs past and future.
