A DUBLIN man forged his wife's signature to en cash her life assurance policy, a court has been told.

A DUBLIN man forged his wife's signature to en cash her life assurance policy, a court has been told.

Judge James Carroll heard that the money allegedly wrongly obtained from the transaction by Mr Gerard Flynn, of Ennafort Park, Raheny, was secured in an investment bond which he was prepared to lodge in the Circuit Court pending the outcome of a District Court appeal.

Ms Ann Kelly, counsel for his estranged wife, Mrs Pier Flynn, of Admiral Park, Baldoyle, Dublin, said her client, who won a District Court decree for more than £3,560, had been defrauded of, the money. Mr Flynn was appealing the District Court order.

A solicitor for the defendant said family law issues between both parties had been dealt with in the Circuit Court and were, under appeal to the High Court.

She said she was precluded in "this open court" from referring, to evidence given in the family law court and therefore could not properly defend her client.

Judge Carroll said that since he had been told a proper defence to the action relied on matters given in evidence in the family law court he would adjourn the case generally with liberty to re enter it at a later date.

In the meantime, his registrar would write to the family law court requesting that it be heard there.
