A languages teacher has brought High Court proceedings claiming she was unfairly dismissed from her teaching job when she was out on sick leave due to vocal problems.

Niamh McSherry, Curragh Chase, Green Road, Newbridge, Co Kildare, who taught English German and French at Scoil Chriost Ri, Presentation Secondary School, Portlaoise, Co Laois, claims she suffered anxiety, stress and breach of contract arising from her alleged unfair dismissal from her full- time teaching position after she went on unpaid sick leave in October 2003.

The school denies the claims and contends Ms McSherry had not been dismissed.

Following clarification of the Department of Education's scheme for unpaid sick leave, Ms McSherry's position was no longer available because she had exceeded the terms of that scheme on October 21st, 2005, it claims.
