A MAN charged with raping a babysitter told the jury at the Central Criminal Court he did not force the woman to do anything against her will and he did not harm her in any way.

The 36 year old father of four denies he raped her and claims she consented to having sexual intercourse with him.

He said he stopped when she told him she was a virgin and then apologised to her for stopping their sex activity. He didn't continue because he realised it would be painful for her and he didn't think it was appropriate for the woman to have sex for the first time in a neighbour's sitting room.

He said that when he told gardai "nothing had happened" between them he meant nothing had happened in a forceful way.

He had not used force on her.

Replying to Mr Patrick McCarthy SC (with Mr Michael Delaney), defending, the accused said he was "frightened and shocked" when told of the woman's allegations. He couldn't understand why she would make such claims.

Det Sgt Gerry Lynch agreed with defence counsel, Mr Michael Delaney, that all the samples taken were negative as to any connection between the accused and the alleged victim. The accused had co operated fully regarding the samples.

The man has pleaded not guilty to raping and sexually assaulting the woman on October 10th, 1995, in a Waterford housing estate. It was the second day of the trial before Mr Justice Flood.
