Limerick's new radio service, operated by Treaty Radio Ltd, will tomorrow oppose an application to prevent it from carrying on specific advertising services. Last week Radio Limerick secured a temporary restraining order against Treaty Radio preventing it from carrying on advertising services in the style of 95 FM Limerick or 95 FM Radio Limerick, on the basis that it might cause confusion or deception or lead to advertising services being passed off as those provided by Radio Limerick.
The court was told that Radio Limerick could only be picked up using a television set. It was alleged that Treaty Radio had advertised a new radio service in the area. Counsel for Radio Limerick said it was not seeking to prevent this service opening but rather to protect Radio Limerick's advertising service.
Yesterday, Ms Fidelma Macken SC, for Limerick Radio, told the President of the High Court, Mr Justice Costello, that she was applying for an interlocutory injunction - a restraining order which would continue until the trial of the action - against Treaty Radio Ltd. Mr Michael McDowell SC, for 95 FM, said he would be seeking to set aside the application for an interlocutory order. Mr Justice Costello, said he would put the matter in for hearing tomorrow.
