The proposals were originally agreed by Government in April but postponed due to second review of inquiry.

  • Inquiry to be given power to require sworn statements of witnesses and admit documents in evidence.
  • Inquiry to shift the cost burden on to parties who conduct themselves "unreasonably" during investigation.
  • Evidence already gathered to be protected through a transition mechanism.
  • Government to consult with inquiry to ensure smooth transfer to successor of Miss Justice Laffoy.
  • Proposals to be subject to a review by an "independent and objective" source before legislation introduced.
  • Work continues on second review which will include proposal to hear sample cases.
  • Second review and the above proposals will be subject to the outcome of Christian Brothers' court challenge to inquiry.
