A Co Louth man has been freed on bail by the Supreme Court pending the outcome of his appeal to that court against an order for his extradition to Spain on a charge of homicide of his wife there.

The bail terms imposed on Michael Dermot McArdle include a requirement that he report daily to Dundalk Garda station and that he not interfere with the family of his deceased wife.

On May 27th last the president of the High Court, Mr Justice Joseph Finnegan, made an order for the extradition to Spain of Mr McArdle (36), of Brookfield, Heynestown, Dundalk.

The order was the first of its kind to be made in the State under the European Arrest Warrant Act, 2003, which came into effect in January 2004.

Mr McArdle's extradition was sought on a charge of homicide of his wife, Kelly Anne, who died following a fall from a hotel balcony in Marbella on February 12th, 2000.

Mr McArdle has appealed that order to the Supreme Court, but a date for the appeal has yet to be fixed.
