The Law Reform Commission report recommends the creation of new criminal offences:
installing or using secret audio or visual recording devices to infringe an individual's privacy;
trespassing on private property with the intention of observing, overhearing or obtaining information;
intentionally listening to or recording all or part of a conversation without the consent of at least one party to the conversation;
disclosing information obtained through secret recording or trespassing.
It also recommends the creation of new torts, or offences against civil law, over which an individual could take legal action:
the invasion of the privacy of another person by means of surveillance;
the harassment of another person;
the disclosure within the State of information obtained through privacy-invasive surveillance, whether the surveillance was carried out within or outside the State.
