Mr Justice Barry White told the court that the trial would not get under way until tomorrow morning because an edited version of the book of evidence had to be produced for Mr Kearney's defence counsel, Patrick Gageby SC.

Mr Justice White told the jury that the State had an obligation to provide the court and defence with a book - which is known colloquially as the book of evidence and which included the names of witnesses who would be called to give evidence, statements taken from witnesses and a list of exhibits.

The judge said the prosecution, led by Denis Vaughan Buckley SC, agreed there was some evidence in the book that should not be put before the jury.

He instructed the jury to return at 11am tomorrow, when the trial will begin.
