Soliciting to murder trial is postponed

The start of the trial of Eamon Tuohy, who is accused of soliciting a man to murder another man, has been postponed until this morning.

Mr Tuohy has pleaded not guilty to soliciting David Coleman to murder Joe Gallagher jnr in Navan, Co Meath, between June 1st and September 30th, 2004.

Mr Justice Barry White told the jury yesterday there was "a legal issue which requires resolution" and asked them to return this morning when the trial will begin.

Men get three years for assault

Two men who seriously assaulted a Ballymun, Dublin, man who later died have been given three-year sentences at Dublin Circuit Criminal Court. Jason Harris (33) and Roy Marshall (24) took part in a drunken assault after a party on Gregory Rowan (44), who was later found dead.

Harris, Temple House, Hill Street, and Marshall, Cedar House, Marlborough Street, Dublin, pleaded guilty to assaulting Mr Rowan causing him serious harm at Sillogue Road, Ballymun, on August 16th, 2006.

Judge Frank O'Donnell imposed a three-year sentence on the pair and suspended the final year.

Sgt Noeleen McKenna said Mr Rowan died shortly after the drink-fuelled assault but they had not been charged in relation in his death.

20,000 awarded over truck crash

A 16-year-old girl who suffered post-traumatic stress following the jack-knifing of an articulated truck into her home has been awarded €20,000 in the Circuit Civil Court.

The court heard that Niamh Cunningham, Stone Lodge, Balrath, Co Meath, was in the house with her mother, Anne, on November 15th, 2005, when the truck swerved to avoid a car in which an elderly man had just suffered a fatal heart attack.

Judge Alison Lindsay heard Niamh had cerebral palsy and required significant supervision and care.

Sentencing today over tourist deaths

A Tallaght man will be sentenced today at Dublin Circuit Court for causing the death of two French tourists in a car crash last year.

John Cash (26), Sundale Green , pleaded guilty to dangerous driving causing the deaths of Martine Talon and Martine Liotard at Kylemore Road, Ballyfermot, on May 16th, 2007.

Judge Katherine Delahunt adjourned sentencing overnight to allow her read reports handed into court.

The court heard the two French tourists were walking along the Kylemore Road when a car driven by Cash travelled to the wrong side of the road, mounted the pavement and struck the women, killing them instantly.

Garda Feifhlim McKenna said Cash, who had been drinking heavily, climbed into the back seat of the car before gardaí arrived and told them another person had been driving, but admitted responsibility the next day.

Teacher on trial for sex assault

A Dublin teacher who allegedly sexually assaulted a then seven-year-old boy at least once a week for two years has gone on trial at Dublin Circuit Criminal Court.

The 62-year-old accused has pleaded not guilty to eight counts of indecent assault on the boy in a Dublin primary school between September 1967 and June 1969.
